Victor Danhi is a partner in the automotive group. He represents national and regional automotive dealership clients in consumer class actions and complex litigation, federal and state regulatory matters, unfair competition claims, commercial and consumer litigation, and franchise disputes. Victor has successfully defended clients at trial before juries, judges, and arbitrators. He has extensive experience in the effective resolution of high-stakes litigation, litigation avoidance and regulatory compliance.

Previous Work
Prior to joining Arent Fox, Victor was an associate in the Los Angeles office of a national law firm in the automotive group. Additionally, he brings 19 years of technical and managerial experience in military and commercial aerospace and satellite communications to his legal practice. He negotiated and drafted major subcontracts for a leading communication satellite manufacturer and advised its purchasing agents on legal issues affecting government and commercial procurement.

Professional Activities
Victor is a member of the American Bar Association, the Los Angeles County Bar Association, the Orange County Bar Association, and the Beverly Hills Bar Association.

Life Beyond the Law
Victor enjoys outdoor activities and traveling with his wife, Jane. On weekends he can be found sailing locally or heading to Catalina Island. He is a member and Judge Advocate of the Seal Beach Yacht Club and a member of the American Legion Yacht Club of Newport Beach.

US Supreme Court Orders 9th Circuit to Reconsider Service Advisor Overtime Exemption

On Monday, the US Supreme Court ordered the Ninth Circuit to reconsider whether Service Advisors are exempt from overtime under the Fair Labor Standards Act (FLSA). SCOTUS issued its Order with direction to avoid taking the US Department of Labor’s most recent regulations into account, finding the regulations were issued without adequate explanation.

U.S. Supreme Court Orders Ninth Circuit to Reconsider Whether Service Advisors are Exempt from Overtime Under FLSA

In a 6-2 decision, the Supreme Court vacated the 9th Circuit’s March 2015 decision that service advisors should be eligible to receive overtime compensation under federal law.  The Supremes remanded the case to the 9th Circuit to interpret the statute without giving weight to the 2011 regulation.  The gist of the now remanded 9th Circuit ruling was that service advisors should not be exempt from overtime under the FLSA, reasoning that DOL’s regulations excluded only salespeople and mechanics, and not service advisors.  In today’s decision, the SCOTUS held that it will not give deference to the DOL’s 2011 regulation, which reversed the Department’s prior position.  The Court explained that Section 213(b)(10)(A) of the FLSA must be construed without placing controlling weight on the U.S.
